The Site is an online information service provided by Mahlab Media Pty Ltd (ABN 48 079 955 114), described as Mahlab, we, us or our in this Privacy Policy and Site Agreement.

1. Purpose and Scope

This Privacy Policy and Site Agreement:

• governs the use of the Site at and its associated services, web pages, domains and sub-domains, which are owned and operated by Mahlab, and

• describes our policies and procedures on the collection, use, disclosure and protection of your personal information provided to us or otherwise collected by us, offline or online, including through the Site.

This Privacy Policy and Site Agreement applies to everyone who accesses and uses our Site, and your access to and use of the Site is subject to your agreement to and compliance with this document. Mahlab may modify this document at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the Site. You agree to review this document periodically to be aware of such modifications and your continued access or use of the Site shall be deemed your conclusive acceptance of the modified agreement.

The contents of the Site are protected by international copyright and trademark laws. The owner of the copyrights and trademarks are Mahlab, its affiliates or other third party licensors. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, the material on the Site, including text, graphics, code and/or software. You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. 

You agree to grant to Mahlab a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the Site or by e-mail to Mahlab by all means and in any media now known or hereafter developed. You also grant to Mahlab the right to use your name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto. You agree that you have no recourse against Mahlab for any alleged or actual infringement or misappropriation of any proprietary right in your communications to Mahlab.

You understand that, except for information, products or services clearly identified as being supplied by Mahlab, Mahlab does not operate, control or endorse any information, products or services on the internet. Except for Mahlab-identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties, that are not affiliated with Mahlab. You understand that Mahlab cannot and does not guarantee or warrant that files available for downloading through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

You assume total responsibility and risk for your use of the Site and the internet. Mahlab provides the Site and related information “as is” and does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or noninfringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the Site, any merchandise information or service provided through the Site or on the internet generally, and Mahlab is not liable for any cost or damage arising either directly or indirectly from any such transaction. You acknowledge that the Site contains information and/ or software, photographs, audio and video clips, graphics, links and other material that are protected by copyright, trademark or other proprietary rights of Mahlab or third parties, including but not limited to product names, logos, designs, titles, and words or phrases which may be registered in certain jurisdictions (collectively, the Content). You agree to comply with any additional copyright notices, information, or restrictions contained in any Content available on or accessed through. If you want to use any content of for any reason you must obtain prior express written permission of Mahlab.

You may not modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content, in whole or in part. Content consisting of downloadable software may not be reverse-engineered unless specifically authorized by Mahlab or the owner of the software’s patent and or copyright. Subject to the provisions of this Copyright Notice, you may post on content owned by you (such as your original statements), content for which you have received express permission from Mahlab, and content in the public domain. You assume all right and responsibility for determining whether any content is in the public domain. 4. Anti-Spam Policy Notice 

This sets out our policy with regard to the use of Spam marketing techniques in connection with Internet Marketing. In the event that we deem you to be in violation of these policies, we shall immediately revoke your rights and close any active account.

We have a strict policy against spamming. We forbid the sending of unsolicited mass emails or unsolicited emails of any kind in connection with the marketing of our programs, products and services.

We reserve the right to terminate your account and participation in our programs “for cause” if we deem you to be in violation of our anti-spamming policies. We also reserve the right to suspend your account and participation pending review upon receipt of any complaint or other evidence that you may be engaging in any spamming activity.

We consider spamming to be any activity whereby you directly or indirectly transmit email messages to any email address that has not solicited such email and does not consent to such transmission. We also consider spamming to constitute posting advertisements in newsgroups in violation of the terms of participation in such newsgroup, that are off topic, or in newsgroups that do not specifically permit advertisements. This Privacy Policy sets out our commitment to complying with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth), and to protecting the privacy of Personal Data provided to us, or otherwise collected by us, offline or online, including through the Site

By providing us with personal information, you consent to the disclosure of your information outside of Australia and acknowledge that we are not required to ensure that overseas recipients handle that personal information in compliance with Australian Privacy law. You acknowledge that some overseas third parties may not be regulated by the Privacy Act and the Australian Privacy Principles in the Privacy Act and if any third party engages in any act or practice that contravenes the Australian Privacy Principles, it would not be accountable under the Privacy Act and you will not be able to seek redress under the Privacy Act. 

Disclosure of Personal Information outside Australia

We may disclose personal information to our related bodies corporate, partnerships, joint venture entities and external service providers located overseas for some of the purposes listed above. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information. We may disclose your personal information to entities located outside of Australia including our data storage, web-hosting and server providers and other external service providers.

How we treat personal information that is also sensitive information

Sensitive information is a sub-set of personal information that is given a higher level of protection under the Australian Privacy Principles. Sensitive information means information relating to your racial or ethnic origin, political opinions, religion, trade union or other professional associations or memberships, philosophical beliefs, sexual orientation or practices, criminal records, health information or biometric information.

Your rights to access and correct your personal information

How is Personal Information stored and secured?

We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

7. US Privacy Policy 

This Privacy Policy sets out our commitment to complying with the US privacy laws to the extent these apply to Mahlab and protecting the privacy of Personally Identifiable Information provided to us, or otherwise collected by us, offline or online, including through the Site. This Privacy Policy applies to users of the Site who visit without transacting business (Visitors) and users who make use of the various services offered by Mahlab (Authorized Customers).

Personally Identifiable Information 

Personally Identifiable Information refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

What Personally Identifiable Information is collected?

We may collect basic user profile information from all of our Visitors. We may collect the following additional information from our Authorized Customers: the names, addresses, phone numbers and email addresses of Authorized Customers, the nature and size of the business, and the nature and size of the advertising inventory that the Authorized Customer intends to purchase or sell.

What organizations are collecting the information?

In addition to our direct collection of information, our third party service vendors (such as credit card companies, clearinghouses and banks) who may provide such services as credit, insurance, and escrow services may collect this information from our Visitors and Authorized Customers. Visitors and Authorised Customers may opt out of receiving unsolicited information from or being contacted by us and/or our vendors and affiliated agencies by responding to emails as instructed, or by contacting us at [email protected]

What partners or service providers have access to Personally Identifiable Information from Visitors and/or Authorized Customers on the Site?

Mahlab has entered into and will continue to enter into partnerships and other affiliations with a number of vendors. Such vendors may have access to certain Personally Identifiable Information on a need to know basis for evaluating Authorised Customers for service eligibility. Our privacy policy does not cover their collection or use of this information.

Disclosure of Personally Identifiable Information to comply with law. 

We will disclose Personally Identifiable Information in order to comply with a court order or subpoena or a request from a law enforcement agency to release information. We will also disclose Personally Identifiable Information when reasonably necessary to protect the safety of our Visitors and Authorised Customers.

How does the Site keep Personally Identifiable Information secure?

All of our employees are familiar with our security policy and practices. The Personally Identifiable Information of our Visitors and Authorized Customers is only accessible to a limited number of qualified employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. Can a Visitor delete or deactivate Personally Identifiable Information collected by the Site?

We provide Visitors and Authorized Customers with a mechanism to delete/deactivate Personally Identifiable Information from the Site’s database by contacting [email protected]. However, because of backups and records of deletions, it may be impossible to delete a Visitor’s entry without retaining some residual information. An individual who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use Personally Identifiable Information relating to that individual in any way moving forward.

What happens if the Privacy Policy Changes?

We will let our Visitors and Authorized Customers know about changes to our privacy policy by posting such changes on the Site. However, if we are changing our privacy policy in a manner that might cause disclosure of Personally Identifiable Information that a Visitor or Authorized Customer has previously requested not be disclosed, we will contact such Visitor or Authorized Customer to allow such Visitor or Authorized Customer to prevent such disclosure.

Retention of your Personal Data

Mahlab will also retain Usage Data for internal analysis purposes.
